Your Nevada statute appears consistent with our Mississippi statute and similar to others like it around the country. Implied consent to withhold or withdraw LST could be viewed as contained in 5. of the Nevada law. Substituted judgment combined with the physician acting in good faith and following the standard of care might allow for implied consent. Under some circumstances, the patient's consent to withhold or withdraw LST can be implied if the surrogate knows the values and wishes of the patient, the health care team is exercising due diligence, and the standard of care is followed.
