Goodness, that's 101 scenarios! #1 and #2 would be dictated by the contract that the hospital and the hospice(s) establish to provide care. The contract would also need to specify who will be responsible for providing the care--hospital vs. hospice staff. If the hospital has contracts there would need to be clarity that there is not a conflict of interest with parties that provide leadership on the board of the hospice program. When a hospice is a part of the same healthcare system that also changes the playing field. There needs to be caution with any hospice "giving away care" as this could be construed by medicare that this is an enticement to get referrals to the hospice program. Keeping clear the responsibilities of the hospice program staff vs. the hospital staff is critically important.

The response from Sharol Herr is right on target. The only things I would add are 1)the hospice representatives negotiating the partnership should be very clear about the relevant content in the CMS Conditions of Participation, 2) both parties should seek the advice of health care attorneys versed in the requirements of the State in which the hospice and the hospital are located. Note: the tax status of the hospice per se does not dictate any difference(s) in the financial agreement between the parties.
