The response from Sharol Herr is right on target. The only things I would add are 1)the hospice representatives negotiating the partnership should be very clear about the relevant content in the CMS Conditions of Participation, 2) both parties should seek the advice of health care attorneys versed in the requirements of the State in which the hospice and the hospital are located. Note: the tax status of the hospice per se does not dictate any difference(s) in the financial agreement between the parties.
