Each entity that is doing the analysis -- CMS, US News, HealthGrades, Thomson-Reuters, etc. -- is determining both the observed and expected number of deaths, using Medicare data in most cases. Each entity does this somewhat differently, but all are relying on the ICD-9 diagnosis and procedure codes uploaded to Medicare to determine nationally how many patients actually died with a given degree of acuity / severity of illness type of measure, during the same time period (e.g., during the three years tapped for analysis). For further information on how CMS does this, see their documents on the qualitynet.org website. They do a great job of making a statistically complex topic understandable.
