Yes there are a number of exclusion criteria we did not cover. For CMS "Hospital Compare, as you note, patients who leave "Against Medical Advice (AMA)" are excluded. Patients with a length of stay of less than or equal to one day are excluded as well. The complete description of all inclusion and exclusion criteria are described nicely in the FAQ document in the mortality rate section of QualityNet.Org.
Regarding your second question, the CMS "Hospital Compare" mortality measures are using only Medicare Fee-for-Service (FFS) enrollees who were 65+ at time of index admission, and with one complete year of Medicare enrollment prior to that (since their risk-adjustment models include data from encounters prior to the index admission).
