Post NP billing for both inpatient and outpatient pc

If our NP is consulted to see a patient in the inpatient setting and bills an initial consult, and then sees this same patient after discharge in the setting of a physician practice here at the hospital for palliative care....would the 3-yr rule for new patient be applied or would the bill for the office visit be an initial also. We would be billing under the same tax id in both settings. Is the 3 yr rule for new or established patient strictly within the outpatient setting even though it's the same palliative care practitioner seeing the same patients in the hospital and after in an office?
