I need a point of clarification.
If I see an inpatient consultation I bill a 99223. the patient is discharged. I see them in outpatient clinic and bill 99213 (existing). they are readmitted for new episode of acute care in the hospital can I bill 99223 or do I have to bill 99233

The initial inpatient visit codes are not broken out by new or established patients like the outpatient E/M codes. Every intital visit during an patient's inpatient stay can be billed with 99221-99223. If your performing a consult and your patient doesn't have Medicare you should be using 99251-99255.
