Post billing for family meeting

Hi,
I wondering if the medicare rules changed in 2010 regarding billing for a family meeting at home or in an ALF/SNF when the patient cannot participate (in this situation-end stage dementia precluded her involvement). My understanding is that with the 2008 rules, the patient had to be present but I'm not clear if that is still true.
